The federal appeals court has upheld a ban on deploying national guard in the Oregon city, after a recent legal decision.

Judicial Panel Concurs to Rehear Case

The federal appeals court decided on Tuesday that it would reexamine the case concerning the president’s authority with an larger group of eleven justices. The court also overturned a earlier decision from a three-judge panel that had sided with the federal government.

Ongoing Dispute Over Military Presence

This order represents the most recent development in a protracted court case over whether the former president has the legal right and justification to send state military units in Portland. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in due to ongoing demonstrations.

Conflicting Arguments

The federal government has claimed that government employees at the immigration center in the southern part of the city were facing threats, while city and state officials assert that local officers have control of the situation.

Contrary to descriptions of the city as “war ravaged”, locals have been posting videos of lush hiking trails and a vibrant culinary culture, and organizing activities such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The appeals court decision came after a US district judge in Portland issued two legal injunctions this month – one preventing the federalization of the state troops, and another stopping the use of any military personnel in Oregon, after efforts to evade the first order by calling up out-of-state forces.

On Monday, the ninth circuit panel had put the first ruling on hold – permitting command of 200 Oregon national guard – but the subsequent injunction remained in place, preventing the actual deployment of the troops.

En Banc Review

The Tuesday decision means the matter will be heard “en banc” – with all decisions under consideration together – by a panel of 11 judges.

“This decision shows that facts are important and that the judicial system are striving to ensure government responsibility. The constitution limits the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” said the state attorney general in a official comment.

“The judicial body is sending a clear message: the president cannot send the armed forces into American urban areas without cause. We will continue defending state legislation, principles, and sovereignty as this legal proceeding progresses and our legal battle continues in the judicial system.”
